Gym contract cancellation law in Georgia

Georgia sets its own rules for cancelling a gym contract, and they sit in Georgia Code section 10-1-393.2. The state's official consumer protection page quotes the statute: 7 business days to cancel after signing (section 10-1-393.2(e)), or 7 business days after the spa opens for pre-sale contracts (section 10-1-393.2(l)). A contract that leaves out the cancellation date is void and unenforceable under state law. Your signed contract still matters, so read it next to the statute before you send anything.

What this means when you cancel

  1. Compare your contract with the statute

Open your signed contract and mark its notice period, its end date and where notices go. Hold those against the Georgia statute so you know which rule gives you the earliest exit.

  2. Quote the statute in your letter

Name Georgia Code section 10-1-393.2 in your letter and say which right you are using, such as the cancellation period or a condition the statute lists. A club that sees the statute named knows you have read it.

  3. Mail it with a receipt

Mail the letter by Certified Mail with Return Receipt and keep the receipt. How to cancel a gym membership by mail walks through each step.

  4. File your copies and watch your statements

Hold on to every document, including the delivery record, until the club has stopped billing you.

A short, dated, written notice that cites Georgia Code section 10-1-393.2 gives you a clear record in Georgia.
