Gym contract cancellation law in Virginia
If your gym is in Virginia, Va. Code sections 59.1-297, 59.1-297.1 and 59.1-299 is the law to check first. Cancel without penalty within 3 business days, with a full refund. Also cancel if the club closes or relocates with no comparable club within 5 driving miles, or on death or physical inability to use the services for 30 or more consecutive days (needs a medical statement). What this means when you cancel
Start with the contract you signed
Find the dates, notice terms and cancellation address in your gym contract, then compare them with the Virginia points above. Note any deadline that has not passed yet.
Cite the statute when you write
Say in one sentence that you are cancelling under Va. Code sections 59.1-297, 59.1-297.1 and 59.1-299. Then ask for written confirmation and for all future charges to stop.
Post the letter by certified mail
Use certified mail, not a regular stamp. You want a postmarked receipt and a delivery record that you can show if the club says it never received your notice.
Keep everything until the last charge clears
File your copies together and watch your next two statements. If the club charges you after the date your cancellation took effect, your papers are the proof.
If the club ignores your Virginia notice, your proof is the record you will need for a refund request or a card dispute.
Send your cancellation by certified mail
