  • Cancel for a full refund by certified mail by midnight of the 3rd business day, refunded within 30 days.
  • A partial refund applies if the spa closes or relocates more than 10 miles, fails to provide advertised services, or on the member's death or total and permanent disability.

What this means when you cancel

  1. Start with the contract you signed

Put your contract on the desk next to Tex. Occ. Code sections 702.303, 702.304, 702.307 and 702.308. Write down the term, the notice rule and any cancellation address, and check whether the statute gives you a right the contract does not mention.

  2. Name the law in your letter

Say in one sentence that you are cancelling under Tex. Occ. Code sections 702.303, 702.304, 702.307 and 702.308. Then ask for written confirmation and for all future charges to stop.

  3. Mail the notice with tracking

Mail the letter by Certified Mail with Return Receipt and keep the receipt. How to cancel a gym membership by mail walks through each step.

  4. Keep everything until the last charge clears

Keep your records until the last charge has cleared. If a payment still goes through afterward, show the club your proof and, if needed, your bank.

Statutes change. The link above goes to the official text, so check it again if your contract was signed some time ago.
